Case Strategy Testimonials
Three months before we were set to try an employment case in federal court in Montana, we sought help from Tsongas. We were asserting three claims, each requiring a separate damage calculation, and the facts were more complicated than usual in such cases. We asked Tsongas to help us distill the story and to develop demonstrative exhibits. One of the exhibits Tsongas crafted was a timeline that proved to be invaluable (a half hour into deliberations, the jury sent a note asking for the timeline – and a calculator). After seeing the Tsongas exhibits, we decided to hire Tsongas to help prepare our client to testify so that he could tell the truth well. In a couple of intense sessions, Tsongas taught our client strategies that made him more confident on the stand and improved his ability to tell his story under cross and direct conditions. With Tsongas’s help, our client received a verdict that awarded both compensatory and punitive damages and that looks to be a record recovery for a Montana employee.- Tom Singer, Axilon Law Group, PLLC, Billings, Montana
We have worked with Tsongas Jury Consultants for years. Recently we had the chance to work with Tsongas Trial Consultants in a plaintiff product liability case. It was a tough case, and we had only a modest budget for jury consulting, but we wanted to make sure we were on the right track and get their advice on how to execute the trial theme strategy, jury selection, and trial graphics. Tsongas got up to speed quickly and we worked collaboratively with them to develop, simplify, and refine trial themes. Their astute understanding of jury behavior allowed us to target the case themes to our jury; they assisted us in developing a comprehensive and practical jury selection strategy, and they worked with us to develop and produce a number of demonstrative exhibits to express our case themes and organize and frame our evidence visually for the jury. The jury verdict was a great success for our clients and we appreciate Tsongas’ professionalism, experience, and responsiveness to our particular needs. We look forward to using them again.- Matthew J. Sekits, Bullivant Houser Bailey, PC
I have relied on the sound wisdom and practical advice of the Tsongas team for years. Their commitment to delivering excellent service is one of their strongest traits. I recently worked with members of the team on the development of case themes, jury selection, opening statements, and closing arguments in three cases and the results have been excellent. I would not hesitate to recommend the Tsongas team to those looking for reliable, dedicated, and valuable strategic litigation partner.- Craig A. Thompson, Esq., Venable LLP, Baltimore, MD
My colleagues and I have worked with Tsongas on theme development, jury selection, witness preparation, openings and closings in multiple product liability (prescription drug) cases. Their insight has been invaluable in helping us shape an effective story and selecting the best juries possible. They provide concrete suggestions and feedback in an efficient manner. For all these reasons, they quickly became an integral part of our team. We are better advocates because of their guidance. I recommend them to anyone needing this type of jury consulting, and I look forward to working with them for many years to come.- Sherry Knutson, Tucker Ellis LLP, Chicago, IL
“I and others at my firm have worked with Tsongas trial consultants for years. We recently engaged Tsongas in a highly challenging and complex commercial case that was ultimately tried over 5 weeks in federal court. The Tsongas consultants provided valuable input in assessing the case strengths and weaknesses, crafting an appropriate story strategy, and developing a compelling opening statement. In addition, they also assisted us in jury selection, bringing a sound and scientific methodology to the process of evaluating potential jurors, and worked with us in preparing one of our key trial witnesses. We recommend them highly and look forward to working with them again.”- Cori Gordon Moore, Perkins Coie LLP, Seattle, WA
Guest lectures by Tsongas Litigation Consulting have provided enormous benefit to my Pre-Trial and Trial Advocacy students at the University of Washington School of Law. While analysis of legal issues is critical in practice, so is the development of litigation and communication strategies. Tsongas Consulting specializes in these, developing fine-tuned case stories, with a keen eye focused on language, rhetoric and visual imagery, as well as jury impact. The dynamic, interactive Tsongas teaching style fits right in with the 21st Century digital era, building skills essential to success in working with clients, judges, juries and other counsel.- William S. Bailey, University of Washington School of Law, Seattle, WA
“We recently worked with Tsongas trial consultants on a complex civil case, involving multiple claims, counterclaims, allegations of fraud, Lanham Act violations, trade libel, conspiracy, as well as trademark infringement. They immediately rolled up their sleeves and dug into the important documents and relevant deposition testimony. They quickly grasped the case and helped us conduct a thorough and well-designed mock trial where we were able to test our case themes and strategies. In addition, they assisted us with preparing witnesses before and during trial, jury selection, and opening and closing. They were with us in court the entire trial, offering fast feedback and daily suggestions and insights. They became a part of our trial team and were there with us late into the night, always with valuable suggestions and insight, and with a positive “can do” attitude the entire time. I valued their input a great deal; it was helpful and consistently on point.
Moreover, I enjoyed their company. I was so impressed that I had Tsongas co-present with me at a Dallas Bar Association conference on the art and science of jury selection. The program was well-attended and very well-received.
Tsongas will make a difference in your case. By the time you are walking into court on the first day of trial, you are better prepared as a result of Tsongas’s involvement in your pre-trial. I definitely will use them again and heartily endorse trial consulting services to clients and fellow practitioners of the art of trying cases.”- John W. Bickel, Bickel & Brewer, Dallas, TX
“I recently had a major trial court hearing on a matter involving complex real estate law. I knew beforehand that it would be challenging to explain my position to a judge who isn’t highly versed in the details of this nuanced body of law. Graphics would be particularly important in this instance since I knew that my best road to success was making sure I had an argument that was easy to understand and penetrated with compelling information. I called Tsongas for help, and together we devised a strategy and the supporting vivid and dynamic graphics that explained my client’s position clearly and persuasively. The result was a fortunate 100% victory for me and my client. I strongly recommend Tsongas. They provide invaluable insights along with the graphic tools to make complex information clear and compelling to a trier of fact. Tsongas is intuitive, 100% client focused, and professional.”- Jim Holland, Hall & Holland, Vancouver, Washington
“For many years, Tsongas Litigation Consulting has provided me with tailored jury consulting services in complex business litigation cases and legal malpractice cases. Whether it’s simply a few hours of witness preparation or a full-blown trial strategy session with jury selection assistance, I’ve found Tsongas to be responsive, practical, and cost-effective. They are professional and well-grounded. I always look forward to working with them.”- Joseph C. Arellano, Kennedy, Watts, Arellano & Ricks LLP, Portland, OR
“I have worked with Tsongas jury consultants for years, as a practicing trial lawyer and now as a General Counsel. Tsongas has assisted me in the development of case strategy and its execution. In particular, they have helped in the preparation of our key witnesses to tell the truth well in depositions. We recently worked with Tsongas on a complicated breach of contract case, working with some of our highest level employees. Tsongas, working directly with me and our outside counsel, helped us have our witnesses feel truly comfortable with the process, control the deposition situation and tell the truth in an efficient manner. I do not hesitate recommending their trial consulting services to my peers who want their witnesses to be prepared for the trial strategy and tactics of opposing counsel, so the witness can control the process, and tell what actually happened in the clearest, most efficient and most persuasive way.”- Alexander A. Baehr, Colliers International, Seattle, WA
“I have worked with Tsongas trial consultants for years. Most recently they assisted us in a legal malpractice case that had some particular complexities and challenges. Their process and method of analyzing cases and developing a coherent and persuasive case strategy is highly practical and illuminating. They helped us make the case efficient and more manageable for a jury. In addition, they designed and developed demonstrative exhibits for opening and closing, helping us package and present our information in efficient and appealing ways. They were responsive, took direction when needed, made strong recommendations when they felt they needed to be made, and we worked as a team to the great benefit of our client.”- Christopher W. Tompkins, Betts, Patterson & Mines, P.S., Seattle, WA
“The members of the Tsongas team provide an insightful sounding board for trial themes, strategy, and translating complex or mundane facts into easy-to-understand concepts. Early in a case’s preparation, I found that their case strategy exercise provides a fantastic way to organize case themes and deficiencies – on both sides of the case. I also found that Tsongas consultants have real-world experience in IP cases that assists litigators beyond the traditional feedback that a general trial consultant might provide. In a recent trial, Tsongas helped our team prepare for voir dire and streamline our case presentation, and received useful feedback throughout the trial. It is difficult to argue with the results in both cases, which were resolved overwhelmingly in our clients’ favor.”- Bobby Ghajar, Pillsbury Winthrop Shaw Pittman LLP, Los Angeles, CA
“I recently worked with Tsongas on a mock trial in Southern California to prepare for my employment defense jury trial. I found that their mock trial approach was organized and efficient, and that they paid great attention to the critical details. But, more importantly they provided very useful and practical recommendations for trial strategy. Their rapid grasp of the case issues, and how jurors respond to particular evidence, case themes, and jury instructions was most helpful. They offer constructive advice, engage in helpful dialogues about particular elements of the litigation and trial strategy, and they went beyond providing just a service. They became more members of the trial team as they helped us gear up for the trial. I would not hesitate to recommend Tsongas services for my clients.”- James A. Zapp, Paul Hastings, Los Angeles, CA
“I have retained Tsongas for the last five years to help me win complicated employment defense trials in multiple states throughout the West Coast. Whether it is assisting my witnesses in telling the truth well and in the most effective and persuasive manner; conducting a mock trial to help me assess the risks of my case and then refine a trial strategy to minimize those risks; or helping me to pick a jury; Tsongas has always provided the best of service and insight. Tsongas trial consultants have helped me with early assessment of my most difficult cases and helped to develop an effective defense narrative at the early stages of the litigation. They have helped to develop key demonstrative exhibits for trial and have conducted highly valuable post-verdict interviews. All of their work is performed on a timely basis and with excellent attention to detail. I have found Tsongas to add tremendous value to my cases. Based on their track record and the superior quality of their work, I do not hesitate to tell my clients that they should make the extra investment so that together, we can get them the best results possible for their cases.”- Portia R. Moore, Davis Wright Tremaine, Seattle, WA
“We have worked with Tsongas consultants for years on large and high profile cases, as well as on jury trials where the exposure and stakes were lower, but the results were still critically important for our clients. We use them to collectively develop case and trial strategy, to enhance our opening and closing statement strategy, to assist us in selecting jurors, and to test our case and themes in mock trials. They make themselves available when they are needed, are quick and responsible to our needs, and always provide quality insight, opinions, and work product. Recently they assisted us in a uniquely challenging legal malpractice defense verdict related to intellectual property. We made use of all these services, and they developed some highly useful graphics for both opening and closing. We recommend them if you have a small case and just need some strategic consulting or if you have a large case where you may want to consider a number of their jury consulting services.”- Robert Sulkin & Greg Hollon, McNaul Ebel Nawrot & Helgren, Seattle, WA
“I have found the Tsongas jury consulting firm invaluable in teaching and assisting in jury selection and theme development, and developing the story points for trial. Two points about working with the firm on a dozen or so cases come to mind. First, there’s nothing so uncommon as common sense. We lawyers tend to forget what makes non-lawyers tick. Second, the Tsongas people with whom I’ve worked–all of them–helped teach me to find the box, and then how to think outside of it, in preparing complex civil litigation for trial.”- Milt Rowland, Foster Pepper, Spokane, WA
“Tsongas provided valuable assistance through a strategy session for a multi-million federal court plaintiff case involving the sale of a business. The complicated, multi-facet claims included breaches of representations and warranties, self-dealing, accounting errors, and a myriad of other issues. In the strategy session Tsongas helped the client and lawyers determine the best story and eliminate extraneous details, while spotlighting the strengths and minimizing weaknesses. This effort was capped with a fine written report, and graphic charts and demonstrative aids that could be used at trial to illustrate the case in pictures as well as words. I look forward to working with Tsongas trial consultants again.”- Roger J. Kindley, Ryan Swanson & Cleveland, Seattle, WA
“I have worked with Tsongas Litigation Consulting on a number of cases over the last decade. Tsongas trial consultants have helped me with graphics, case themes, jury selection and mock trials. I have found their work to be uniformly first rate. They have very good ideas and provide top notch service”- Kelly Corr, Corr Cronin Michelson Baumbardner & Preece, Seattle, WA
“I consider using Tsongas’ services in every case I handle, not just in large exposure cases. Their case strategy process provides me with different types and levels of service customized for the case so I know I’ve always done my “jury due diligence.” I have done many mock trials with many different Tsongas trial consultants. I have always come away with critical insights that were essential prior to trial or ADR. However, I believe that Tsongas is very attuned to the fact that not every case needs a full blown mock trial. They offer cost effective alternatives and my clients appreciate that.”- David A. Ernst, Davis Wright Tremaine, Portland, OR
“I’ve engaged Tsongas on jury trials, bench trials, and arbitrations to collectively develop a strong and persuasive case story that can guide discovery and deposition preparation. They have helped me in intellectual property matters, securities litigation, and other complex commercial cases. The Tsongas team has helped us prepare jury questionnaires, organize pre-trial focus groups and pick a jury and run Shadow Juries for us. I know when I retain Tsongas that I’m retaining the best around, and Tsongas works hard to meet our case schedule, as unreasonable as it may be. They are also very helpful in providing ideas for graphics and other court demonstratives. I do not hesitate to recommend Tsongas trial consultants to other attorneys nor to recommend their retention to my clients.”- Peter Ehrlichman, Dorsey & Whitney, Seattle, WA
“I was impressed by the way Tsongas trial consultants have helped analyze and assess multiple complex issues in several recent cases, involving a toxic tort matter and product liability case. Their case strategy process was of high value, focusing the team on the key issues, sharpening our strengths, identifying areas of strategic concern and helping us craft a stronger case theory. They have performed several large scale focus group exercises on a complex case. My client and I were pleased with their attention to detail in their research methodology, their execution of the research, as well as with their interpretation and analysis of juror behavior. I will be using Tsongas in future cases.”
- Carl Gilmore, K&L Gates, Seattle, WA
“Our firm had the pleasure of working closely with Tsongas trial consultants on a recent plaintiff case that received national attention. Tsongas did not become involved in the case until about seven weeks before trial, after most of the discovery and pretrial motion practice had been completed. In only a couple of conference calls, they grasped the facts, theories, and nuances of our case. Working quickly and efficiently with us, they designed and carried out just the jury research we needed, the results of which gave our whole team the confidence to stick to the game plan they helped us devise, no matter what our opponents threw at us. Their original, instinctive ideas for conveying our messages, which were confirmed through jury research, helped us arrive at the central themes of our case. They deftly used the research to chart out a jury selection strategy that was easy to implement and proved very successful. As the trial progressed, we constantly reminded ourselves of their specific advice and guidance. From opening statement through closing argument, we were lucky to have their specific input on every facet of our case presentation, including the design of key demonstratives. Tsongas consultants get my strongest possible recommendation as jury trial consultants.”- Paul De Marco, Markovits, Stock & DeMarco, Cincinatti, OH
“I recommend using Tsongas jury consultants in your most significant and serious cases in Nevada. I have used them on complex commercial cases, fraud cases, significant plaintiff actions, and construction defect matters. Tsongas offers valuable aid in developing jury trial strategies and the “story” that you will need to tell a jury so that they clearly understand your client’s case and are more willing to fight for it.
Tsongas has a unique and effective method of developing high risk juror profiles, supplemental juror questionnaires, and evaluating high risk jurors by “scoring” the nature of their attitudes and experiences. Their extensive experience with Las Vegas jury attitudes allows them to contribute in the most meaningful ways to case and theme development as well as with voir dire and effective jury selection strategies.
The Tsongas team also provided powerful and engaging demonstrative exhibits and PowerPoint presentations for opening and closing. These have helped me control the key issues in my cases and present juries with a clear and persuasive visual story.
I would not hesitate to call them if you want to give your client a unique advantage.”- Mark A. Hutchison, Hutchison & Steffen, Las Vegas, NV
“Tsongas has a well-earned reputation for providing excellent trial advice and valuable jury research, but we recently learned that Tsongas can help win summary judgment as well. We had the pleasure of working with Tsongas trial consultants on the defense side of a complex patent infringement case in which we obtained summary judgment on the eve of trial. What we realized after the victory was that all the work we had done with Tsongas to develop winning themes for the jury at trial helped us enormously in focusing on the winning issues for the judge at summary judgment.”- Cal Litsey and James Poradek, Faegre & Benson LLP, Minneapolis, MN
